Wedding Photography Services Contract

It is mutually understood and agreed upon by all parties that this is a binding Agreement between the Client and Connor Gleason Photography (the Photographer). The services being provided under this agreement are the photography of your wedding day, ceremony and reception (collectively, the “Event”).

 

A. Retainer Fee and Payment

Client agrees to pay photographer in Full or Retainer Fee at the time of booking to secure their services' date and time. The entire amount of the Retainer Fee is a non-refundable postponement or cancellation fee. Client is bound by this agreement upon signing. The outstanding balance is due on or before 2 weeks prior to the Event. The services cover the time and creative services of the Photographer during the Event, retouching and creative editing of images, presentation via hosted-website, and images included to be sent, or downloaded by Client from the Photographer.  Additional prints or digital images may be available for purchase. All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If Client has arranged a payment plan, order will be placed after the final payment has been received.

B. Location Costs, & Travel Fees

If there are any costs/fees associated with the location the Client has chosen for their session (Parking, admission fees, etc.), you, the Client, will be responsible for those fees. The Photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 30 miles of Bedford, MA.  Any location outside of these limits may be subject to an additional charge of $.35/mile as part of the agreement.

C. Rescheduling

If an illness or situation prevents a photo session from taking place, Client may reschedule their session at least 24 hours prior to their shoot without penalty (For portrait sessions only). Should Client fail to give 24 hours notice, or decide to completely cancel the shoot, the Retainer Fee is forfeited and will not be refunded. Photographer reserves the right to reschedule or assign any photographer to cover the Event, due to scheduling conflict, illness, accident, death, or any other reason, with prior consultation with the Client.

D. Re-shoots / Refunds

Re-shoots of portrait sessions are determined at the sole discretion of the Photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the Photographer.

E. Archive

After six (6) months, all images may be purged from the Photographer’s hard-drive, except as needed for promotional purposes, to be determined by Photographer at Photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

F. Model Release

I hereby give to Connor Gleason Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the Photographer’s name or any other name that he/she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge Photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

G. Copyright

Connor Gleason Photography retains all copyrights to all images created during client’s session. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the Photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise use any image created by Connor Gleason Photography during client’s photo session without permission. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. Note from Photographer: This is my profession. I work very hard to create beautiful images that reflect you and your family, while keeping in line with my artistic vision and creativity.  I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you.  I ask that you simply link back to my website/Facebook page instead of right-clicking, saving, and sharing the image via your own page.

H. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

I. Service Provider

The photographer will be the exclusive professional photographer/media provider at the Event. If there is to be an additional photographer, or other media provider during the Event, the Photographer must approve prior to the event date. The Photographer reserves the right to instruct any other photographer at the event, amateur, professional, or other, to discontinue photographing if their presence or actions create a disruption in normal workflow. If this party refuses, the Photographer will suspend services until the matter is resolved.

J. Force Majeure (an unavoidable accident, "Act of God")

Neither party will be liable for failure to perform any of it’s respective obligations under this Agreement, is such failure is caused by an event outside such party’s reasonable control (i.e., a Force Majeure event) including, but not limited to, an Act of God, Act of War or terrorism, natural disaster, unpredictable weather or the like. However, Force Majeure Events shall not relieve payment obligations.

K. Agreement

This Agreement sets out the complete agreement and understanding if the parties with respect to the subject matter hereof; neither arty is relying on any other oral or written representations in entering into this Agreement. Any amendments made hereto can only be made in a writing signed by both parties. In the event that the Client breaches any material term of this Agreement, the Photographer shall have the right, in its sole discretion, to terminate this Agreement. Upon such termination, the Photographer shall be relieved of all of its obligations hereunder.
